A marriage settlement agreement also referred to as a property settlement agreement is a contract between both spouses that divides the marital assets and marital debts and solves any other divorce-related issue – issues such as child support and custody, alimony, and counsel fees. Because of the potential unpredictability of PA family courts, spouses often choose to create a Pennsylvania marriage settlement agreement so that they can be in greater control of their future. Prior to signing a marriage settlement agreement, it is imperative that both spouses understand the legal implications of the document. If either party fails to follow the terms of the marriage settlement agreement, the Pennsylvania family court can enforce it.
